1. Introduction

These Terms and Conditions of MANRS describe your rights and responsibilities when accessing and/or using the MANRS website, including www.manrs.org and any successor URL(s) (“Website”), and any and all related MANRS software, documentation, and online, mobile-enabled, and/or digital services, including the MANRS Observatory, MANRS Data, and related APIs, made available by ISOC (collectively, the “Service”). Capitalized terms used but not otherwise defined in these Terms and Conditions have the meaning set forth in Section 1.1 below.

By accessing or using the Service, or by clicking a button or checking a box marked “I Agree” (or something similar), you signify that you have read, understood, and agree to be bound by these Terms and Conditions, and you acknowledge that you have read and understood the Internet Society Privacy Notice (“ISOC Privacy Notice”), available at www.internetsociety.org/privacy-policy, the terms of which are incorporated by reference herein. You must read and agree to these Terms and Conditions before using the Service. If you do not agree, you may not use the Service. If you access and use the Service on behalf of a company, organization, or other entity, then (a) “you” includes you and that entity, and (b) you represent and warrant that you are an authorized representative of that entity with the authority to bind that entity to these Terms and Conditions, and that you agree to these Terms and Conditions on the entity’s behalf.

1.1 Definitions

  • Internet Society (hereafter referred to as “ISOC”) – a 501(c)3 non-profit corporation incorporated in the District of Columbia, United States of America.
  • Mutually Agreed Norms for Routing Security (hereafter referred to as “MANRS”) – an ISOC supported initiative to identify and address threats to the Internet global routing system.
  • MANRS Observatory – an online tool to measure the state of routing security on the Internet and conformance of networks with the MANRS Actions, by collecting and aggregating MANRS Data from different sources.
  • MANRS Data – information relating to the state of routing security that is collected, aggregated and stored by the MANRS Observatory to indicate the conformance of networks with the MANRS Actions and made available through the Website and the MANRS application programming interface (hereafter referred to as the “API”).
  • MANRS Actions – best practices defined from time-to-time that aim to address the common threats to the Internet global routing system.

1.2 ISOC may, in its sole discretion, revise or update these Terms and Conditions from time to time, and so you should review this page periodically. When these Terms and Conditions are updated in a material manner, the ‘last modified’ date at the top of this page will be updated and ISOC will notify you that material changes have been made to these Terms and Conditions. Your continued use of the Service after a change has been made to these Terms and Conditions will be treated as your acceptance of that change. If you do not agree to any of these Terms and Conditions or to any future Terms and Conditions, do not access or use (or continue to access or use) the Service.

2. Use of the Service Generally

2.1 ISOC hereby grants you a worldwide, royalty-free, non-exclusive, non-transferrable, revocable, limited license to access and use the Service solely in accordance with these Terms and Conditions and as permitted by the features of the Service.

2.2 Where you are provided with access credentials and/or a key to access the Service, you must keep these credentials and/or keys confidential and not share with any external parties. You assume responsibility for all use of the Service made using your access credentials and/or keys.

2.3 ISOC reserves at all times and without notice, the right to permanently or temporarily throttle, limit or remove your access to the Service with or without notice and without liability, for any reason, including if, in ISOC’s sole determination, you violate any provision of these Terms and Conditions, or for no reason. Upon their termination for any reason or no reason, you will continue to be bound by these Terms and Conditions.

2.4 You may not engage in any of the following prohibited activities: (a) copying, distributing, or disclosing any part of the Service in any medium, including by any automated or non-automated “scraping”, except in connection with your use of the API and receipt of the MANRS Data in accordance with these Terms and Conditions; (b) transmitting spam, chain letters, or other unsolicited email; (c) attempting to interfere with, compromise the system integrity or security or decipher any transmissions to or from the servers running the Service; (d) taking any action that imposes, or may impose at ISOC’s sole discretion an unreasonable or disproportionately large load on the Service’s infrastructure; (e) uploading invalid data, viruses, worms, or other software agents through the Service; (f) collecting or harvesting any personally identifiable information, including account names, from the Service; (g) using the Service for any commercial solicitation purposes; (h) impersonating another person or otherwise misrepresenting your affiliation with a person or entity, conducting fraud, hiding or attempting to hide your identity; (i) interfering with the proper working of the Service; (j) accessing any content on the Service through any technology or means other than those provided or authorized by the Service; or (k) bypassing the measures ISOC may use to prevent or restrict access to the Service, including features that prevent or restrict use or copying of any content or enforce limitations on use of the Service or the content therein.

2.5 ISOC may change the Service, including the MANRS Observatory, the Website and/or API functionality and availability, at any time and without notice.

2.6 You hereby authorize ISOC and its third-party service providers to derive statistical and usage data relating to your use of the Service (“Usage Data”). You agree that all Usage Data is owned solely and exclusively by ISOC, and, to the extent any ownership rights in or to the Usage Data vest in you, you hereby assign to ISOC all rights, title, and interest in and to the same. Accordingly, ISOC may use Usage Data for any purpose in accordance with applicable law and the ISOC Privacy Notice, including, without limitation: (a) to provide and maintain the Service; (b) to develop and improve the Service; (c) to monitor your usage of the Service; (d) for research and analytics and for ISOC’s other business purposes; and (e) to share analytics and other derived Usage Data with third parties, solely in deidentified or aggregated form.

3. Use of the MANRS Data

3.1 Subject to these Terms and Conditions, including the license grant and other terms of Section 2 and the terms of this Section 3, you are free to access, use, copy and publish the MANRS Data that is made available to you through the Service as follows:

  • You may share information about your own network(s) provided it does not contain any personal data.
  • You may share information about other networks to other MANRS participants provided it does not contain any personal data.
  • You may only publicly share information about other networks as aggregated data or otherwise in a form that does not identify those networks, and that does not contain any personal data.

3.2 You may only use the MANRS Data for non-commercial purposes and may not re-sell, re-distribute, or sublicense the information.

3.3 If you publish or present any portion of the MANRS Data, you must acknowledge ISOC and MANRS as the source by including within any such publication or present the following statement: ‘Provided by the MANRS with support from the Internet Society’.

3.4 You must not use the MANRS Data in any way that suggests that ISOC or MANRS endorses yourself, your organization, or your use of the information.

3.5 ISOC may change the MANRS Data feeds at any time and without notice including, for example, adding, modifying and withdrawing the types of information made available.

4. Other Restrictions

4.1 Without limiting the other terms set forth herein, these Terms and Conditions do not:

  • Provide any rights to access the MANRS Data through any other mechanism than the Service;
  • Provide any rights to access the Service after your license and/or right to access has ended, whether by termination by ISOC or otherwise; or
  • Transfer or license any ownership or other intellectual property rights to you or any third party other than the limited license rights explicitly granted herein.

5. Third-Party Links, Information, and Services

The Service may contain links to third-party materials and services that are not owned or controlled by ISOC. ISOC does not endorse or assume any responsibility for any third-party sites, nor for any information, materials, products, or services available on third-party sites or otherwise through third parties (collectively, “Third-Party Materials”). If you access any Third-Party Materials from the Service, you do so at your own risk, and you understand that these Terms and Conditions do not apply to your access to or use of such Third-Party Materials. As such, ISOC is not liable for any damage or loss caused or alleged to be caused by or in connection with your use of or reliance on any Third-Party Materials. The inclusion of Third-Party Materials does not imply ISOC’s endorsement or recommendation of them. You expressly relieve ISOC from any and all liability arising from your access to and/or use of any Third-Party Materials.

6. Release and Indemnity

You hereby release ISOC from all damages (whether direct, indirect, incidental, consequential, or otherwise), losses, liabilities, costs, and expenses of every kind and nature, known and unknown, arising out of a dispute between you and a third party in connection with the Service. In addition, you waive any applicable law or statute, which says, in substance: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM OR HER WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE RELEASED PARTY.”

You agree to defend, indemnify, and hold harmless ISOC and its suppliers, employees, contractors, agents, attorneys, accountants, officers, and directors from and against any and all claims, damages, obligations, losses, liabilities, costs, debts, and expenses (including, but not limited to, attorneys’ fees) arising from: (a) your access to and use of the Service, including any data or content transmitted or received by you; (b) your violation of any of these Terms and Conditions, including, without limitation, your breach of any of the representations and warranties herein contained; (c) your violation of any third-party right, including, without limitation, any right of privacy or intellectual property right; (d) your violation of any applicable law; (e) your willful misconduct; or (f) any other party’s access to and/or use of the Service with your credentials. ISOC reserves the right, in its sole discretion and at its expense, to assume the exclusive defense and control of any such claims, in which case, you agree to cooperate as reasonably requested by ISOC in the defense of such claims.

7. No Warranty

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. USE OF THE SERVICE IS AT YOUR OWN RISK. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE AND ANY INFORMATION AVAILABLE ON OR THROUGH THE SERVICE, INCLUDING THE MANRS DATA, ARE PROVIDED WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM ISOC OR THROUGH THE SERVICE WILL CREATE ANY WARRANTY NOT EXPRESSLY STATED HEREIN. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, ISOC AND ITS SUPPLIERS DO NOT WARRANT THAT MANRS DATA OR ANY OTHER INFORMATION CONTAINED IN THE SERVICE IS ACCURATE, COMPREHENSIVE, RELIABLE, USEFUL, OR CORRECT; THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR SATISFY OR ENSURE COMPLIANCE WITH ANY LEGAL OBLIGATIONS OR APPLICABLE LAW; THAT THE SERVICE WILL BE AVAILABLE AT ANY PARTICULAR TIME OR LOCATION, UNINTERRUPTED, OR SECURE; THAT ANY DEFECTS OR ERRORS IN THE SERVICE WILL BE CORRECTED; OR THAT THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. ANY CONTENT DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICE IS DOWNLOADED AT YOUR OWN RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM(S) OR MOBILE DEVICE(S) OR FOR LOSS OF DATA THAT RESULTS FROM SUCH DOWNLOAD OR FROM YOUR USE OF THE SERVICE.

ISOC IS NOT RESPONSIBLE FOR ANY DAMAGES OR OTHER LOSSES RESULTING FROM THE RELIANCE ON OR USE OF INFORMATION PROVIDED BY ISOC AND/OR THROUGH THE SERVICE.

FEDERAL LAW AND SOME STATES, PROVINCES, AND OTHER JURISDICTIONS DO NOT ALLOW THE EXCLUSION AND LIMITATIONS OF CERTAIN IMPLIED WARRANTIES, SO THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU. THESE TERMS AND CONDITIONS GIVE YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS, WHICH VARY FROM JURISDICTION TO JURISDICTION. THE DISCLAIMERS AND EXCLUSIONS UNDER THESE TERMS AND CONDITIONS WILL NOT APPLY TO THE EXTENT PROHIBITED BY APPLICABLE LAW.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL ISOC OR ITS SUPPLIERS, EMPLOYEES, CONTRACTORS, AGENTS, ATTORNEYS, ACCOUNTANTS, OFFICERS, OR DIRECTORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, OR DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SERVICE, AND/OR TO THE MANRS DATA OR ANY OTHER INFORMATION CONTAINED IN THE SERVICE. UNDER NO CIRCUMSTANCES WILL ISOC BE RESPONSIBLE FOR ANY DAMAGE, LOSS, OR INJURY RESULTING FROM HACKING, TAMPERING, OR OTHER UNAUTHORIZED ACCESS TO OR USE OF THE SERVICE OR YOUR ACCOUNT OR THE INFORMATION CONTAINED THEREIN.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ISOC ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ANY (A) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT; (B) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO OR USE OF THE SERVICE; (C) ANY UNAUTHORIZED ACCESS TO OR USE OF THE SERVERS RUNNING THE SERVICE AND/OR ANY AND ALL PERSONAL INFORMATION STORED THEREIN; (D) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICE; (E) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE THAT MAY BE TRANSMITTED TO OR THROUGH THE SERVICE BY ANY THIRD PARTY; (F) ANY ERRORS OR OMISSIONS IN ANY MANRS DATA, AND/OR ANY LOSS OR DAMAGE INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE THROUGH THE SERVICE.

THIS LIMITATION OF LIABILITY SECTION APPLIES WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER BASIS, EVEN IF ISOC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. THESE TERMS AND CONDITIONS GIVE YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS, WHICH VARY FROM JURISDICTION TO JURISDICTION. THE DISCLAIMERS, EXCLUSIONS, AND LIMITATIONS OF LIABILITY UNDER THESE TERMS AND CONDITIONS WILL NOT APPLY TO THE EXTENT PROHIBITED BY APPLICABLE LAW.

9. Miscellaneous

9.1 Governing Law: These Terms and Conditions and all matters arising out of or relating to these Terms and Conditions, are governed by, and is to be construed in accordance with, the laws of the Commonwealth of Virginia, without regard to the conflict of laws provisions thereof. You irrevocably and unconditionally agree that you will not commence any action, litigation, or proceeding of any kind whatsoever against ISOC in any way arising from or relating to these Terms and Conditions, in any forum other than the courts of the Commonwealth of Virginia.

9.2 Severability: If any provision of these Terms and Conditions is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect.

9.3 California Residents: The provider of services is set forth herein. If you are a California resident, in accordance with Cal. Civ. Code §1789.3, you may report complaints to the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs by contacting it in writing at 1625 North Market Blvd., Suite N 112 Sacramento, CA 95834, or by telephone at (800) 952-5210 or (916) 445-1254.

9.4 Assignment: These Terms and Conditions, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by ISOC without restriction. Any attempted transfer or assignment in violation hereof shall be null and void.

9.5 No Waiver: No waiver of any term of these Terms and Conditions shall be deemed a further or continuing waiver of such term or any other term, and ISOC’s failure to assert any right or provision under these Terms and Conditions shall not constitute a waiver of such right or provision.

9.6 Interpretation: In these Terms and Conditions, “including” means “including without limitation” (and similar terms will be construed without limitation) and headings are for convenience only and will not affect interpretation.

9.7 Entire Agreement: These Terms and Conditions, together with any amendments and any additional agreements you may enter into with ISOC in connection with the Service, shall constitute the entire agreement between you and ISOC concerning the Service.
